1. scope of application

familea's privacy policy describes the collection and disclosure of personal data. This Privacy Policy applies to all processing of personal data. By accessing or using the familea website, users consent to the collection and use of their personal data as described in this Privacy Policy.

familea is committed to handling the personal data of its customers responsibly. Users:inside. 3. scope and purpose of data processing

We process various categories of personal data. The most important categories are as follows:

  • Master data: These are the basic data such as name, contact details, personal data, photos, care. counseling and client history, declarations of consent and information about third parties
  • Contract data: This is data that arises in the context of the provision of our services and the conclusion of contracts, such as contractual services, data relating to the provision of services, data from the run-up to the conclusion of the contract, information on processing (e.g. invoicing) and financial data (e.g. information on financial circumstances for tariff classification).
  • Data on the provision of services: This is data that arises in the course of providing the service, such as health data (e.g. allergies) or preferences (e.g. food preferences). This is usually data about the person receiving care, support or advice, but may also include data about relatives or other third parties (e.g. other caregivers).
  • Applicant dataThis is data that is collected as part of an application for a job with us, such as professional background, education and training, references and data from public sources (e.g. social media and the Internet). This also includes information on criminal convictions and bans on occupations/activities (in particular extracts from criminal records).
  • Communication data: This is data that arises in connection with communication between us and third parties (e.g. by e-mail, telephone, letter or other means of communication), such as the content of e-mails or letters, your contact details and marginal data of the communication.
  • Technical data: This is data that is generated when you use our electronic services (e.g. website), such as IP address, information about the operating system of your device, the region and the time of use. Technical data in itself does not allow any conclusions to be drawn about your identity.
  • Behavioral and preference dataThis is data about your behavior and preferences, such as responses to electronic communications, navigation on the website, interactions with our social media profiles, participation in events, supplemented with information from third parties (including from publicly available sources).
  • Other data: includes in particular: Data that arises in connection with official or judicial proceedings (e.g. files), data that is collected due to health protection (e.g. protection concepts), photos, video or audio recordings that we produce or receive from third parties and on which you are recognizable, participation in events.
4. collection and sources of data
  • From you: You provide us with much of the data we process yourself (e.g. in connection with our services or communication with us). You are not obliged to disclose your data, with exceptions in individual cases (e.g. legal obligations). However, if you wish to conclude contracts with us or make use of our services, for example, we are dependent on your data.
  • From third parties: We may also obtain data from publicly accessible sources (e.g. debt collection registers, media or the internet, including social media) or receive this data from authorities, your employer or client who has a business relationship with us or is otherwise involved with us and from other third parties. This includes in particular the following categories Master data, contract data, data on the provision of services and other data, but also all other categories of data in accordance with section 3 as well as data from correspondence and meetings with third parties.

  • Communication: We process your data in order to be able to communicate with you (e.g. to answer inquiries, process contracts and provide services).
  • Recording, administration and processing of contracts: We process personal data in connection with the conclusion or execution of contracts with you as a parent or legal guardian, suppliers and service providers or other contractual partners. This also includes the enforcement of legal claims arising from contracts, accounting, the termination of contracts and public communication. We also process data as part of the application process and to initiate the employment relationship.
  • Clarification and placement of childcare places: As part of the clarification and placement of childcare places, we process data from you, the persons receiving care and, if necessary, from other persons or organizations. .
  • Advice and supportWe process data from you and, if necessary, from other persons or organizations in the course of providing advice and support.

  • Service provider: We work with service providers in Germany who process data (i) on our behalf, (ii) under joint responsibility with us or (iii) under their own responsibility). This may also include health data.

If you apply for a job with us, we are obliged in particular to disclose your personal details to the competent supervisory authority so that it can check your reputation (in particular an extract from the criminal record). The recipients process the data under their own responsibility.
  • Other people: This refers to other cases where the involvement of third parties arises from the purposes set out in Section 5 Other recipients are, for example, third parties, persons involved in agency relationships or persons involved in official or legal proceedings. As part of our corporate development, we may sell or acquire businesses, parts of businesses, assets or companies or enter into partnerships, which may also result in the disclosure of data to the persons involved in these transactions. In the course of communication with our competitors, industry organizations, associations and other bodies, data may also be exchanged that may affect you.

All these categories of recipients may in turn involve third parties, so that your data may also become accessible to them. We can restrict the processing by certain third parties (e.g. IT providers), but not by other third parties (e.g. authorities, banks, etc.).

7 Deletion of data and storage duration

We process your data for as long as required by our processing purposes, the statutory retention periods and our legitimate interests in processing for documentation and evidence purposes or for as long as storage is technically necessary (e.g. in the case of backups or document management systems). If there are no legal, contractual obligations or technical reasons to the contrary, we delete or anonymize your data after the storage or processing period has expired as part of our usual processes.

8 Rights of the data subjects

When using the familea websites and when providing data in general, users have several options. They can choose not to provide any data at all by not filling out any forms or data fields on familea websites and not using any of the available personalized services. If users choose to provide personal data, they themselves have a right of access, rectification, restriction, erasure, data portability and objection with regard to their data, insofar as this is provided for by applicable law. The same applies to their legal successors, representatives and/or proxies.

8.1 Right to information

At your request, familea will inform you whether or not data about you is being processed.

If such processing has taken place, familea users can request the following information:

  • the purposes for which the data is processed;
  • the categories of data that are processed;
  • the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;
  • the existence of the right to rectification or erasure of data concerning them, the right to restriction of processing by the controller(s) or the right to object to such processing;
  • the existence of a right of appeal to a supervisory authority;
  • all available information on the origin of the data if the data is not collected from the data subject;
8.2 Right to rectification

If your data is incorrect, you have the right to request that the incorrect data be corrected immediately. If your personal data is incomplete, you have the right to request that it be completed.

8.3 Right to restriction of processing

You can request the restriction of the processing of data if in particular:

  • the accuracy of the data is contested for a period enabling the accuracy of the data to be verified
  • the processing is unlawful and the restriction of the use of the data is requested instead of erasure.
  • the data is no longer required for the purposes of the processing, but the familea users need it for the establishment, exercise or defense of legal claims
  • the familea:users have objected to the processing and it has not yet been established whether the legitimate grounds of the controller override their grounds
8.4 Right to erasure

familea users have the right to request the deletion of their data.

The deletion will be complied with immediately if:

  • the data are no longer necessary for the purpose of collection
  • You withdraw your consent to data processing and there is subsequently no other legal basis for the processing
  • You object to the processing and there are no overriding legitimate grounds for the processing
  • The data is processed unlawfully
9. use of the online offers

In principle, you can use the online services without disclosing your identity (namely publicly accessible websites). As part of a contractual relationship with the provider, the disclosure of your identity is required

9.1 Data collection when visiting our websites

If the provider's websites are used purely for information purposes (there is no registration, contract, etc.), the provider only collects the personal data that your browser transmits to the provider's servers. This is the following data, which is technically necessary (not exhaustive):

  • Date and time of the request,
  • IP address
  • Access status/HTTP status code,

Since the collection of data to display the websites and the storage of data in log files is absolutely necessary for the operation of our websites and the maintenance of IT security, you have no option to object in this respect.

9.2 Use of cookies

The familea website uses so-called "cookies" to manage advertising and to determine the popularity of individual subject areas. These text files are stored on the user's system in order to analyze the use of the offers (usage behavior, range measurement, offer optimization and the delivery of target group-specific advertising formats). As a result, users do not have to log in to services that require registration each time they visit, and individualized services can be offered. These text files do not contain any personal data.

The use of cookies can be prevented by appropriate browser settings, but this may impair the functionality of the products. Access to areas requiring registration and the use of certain services is only possible with cookies enabled. Familea accepts no liability for the careless and/or unlawful use of data by third parties and recommends that you consult the data protection provisions of the relevant websites.

10. processing of data in connection with the website and other digital services

When you use our website, data is generated that is stored in logs (in particular technical data). We may also use cookies and similar technologies (e.g. pixel tags or fingerprints) to recognize website visitors, record their behavior and identify preferences. A cookie is a small file that is transmitted between the server and your system and makes it possible to recognize a specific device or browser.

You can set your browser so that it automatically rejects, accepts or deletes cookies. You can also deactivate or delete cookies in individual cases. You can find out how to manage cookies in your browser in the help menu of your browser. Neither the technical data collected by us nor cookies generally contain any personal data.

We also use social media plug-ins, which are small pieces of software that establish a connection between your visit to our website and a third-party provider. The social media plug-in informs the third-party provider that you have visited our website and may send the third-party provider cookies that it has previously placed on your web browser. 11. how do we process on our pages in social networks?

We may operate pages and other online presences on social networks and other platforms operated by third parties and process data about you in this context. In doing so, we receive data from you (e.g. when you communicate with us or comment on our content) and from the platforms (e.g. statistics). The providers of the platforms can analyze your use and process this data together with other data that they have about you. They also process this data for their own purposes (e.g. marketing and market research purposes or to manage their platforms), and act as their own data controllers for this purpose. For further information on processing by the platform operators, please refer to the data protection notices of the respective platforms.
